1. DEFINITIONS

1.1 "Modern Media Digital," "we," "us," or "our" refers to Modern Media Digital, its subsidiaries, affiliates, and authorized representatives.

1.2 "Customer," "you," or "your" refers to the individual or entity purchasing or using our domain registration services.

1.3 "Services" refers to the domain registration, renewal, transfer, and management services provided by Modern Media Digital.

1.4 "Domain Name" refers to the internet domain name registered on your behalf.

1.5 "Registry" refers to the organization or entity responsible for maintaining the central database for a particular Top-Level Domain (TLD).

2. RECURRING PAYMENT TERMS

2.1 Billing Cycle: Your domain registration service is billed on a recurring basis according to the term selected during registration (typically annually).

2.2 Automatic Renewal: Unless you opt out, your domain registration will automatically renew at the end of each registration period. We will send renewal notifications to your registered email address approximately 30, 15, and 7 days before the renewal date.

2.3 Payment Method: You agree to maintain a valid payment method on file with Modern Media Digital for recurring charges.

2.4 Price Changes: We reserve the right to modify our prices with at least 30 days' notice before renewal. Continued use of the services after price changes constitutes acceptance of the new rates.

2.5 Invoicing: Invoices for domain renewals will be issued approximately 30 days prior to the renewal date and are due upon receipt.

3. NON-PAYMENT CONSEQUENCES

3.1 Late Payment: Payments not received by the renewal date are considered late and may incur a late fee of $15 or 5% of the outstanding amount, whichever is greater.

3.2 Grace Period: After the expiration date, domains enter a grace period (typically 30 days, though this varies by TLD) during which the domain remains active and can be renewed at the standard renewal price.

3.3 Redemption Period: After the grace period expires, domains enter a redemption period (typically 30 days) during which the domain is deactivated but can be recovered with payment of the renewal fee plus a redemption fee (typically $80-$150, depending on the TLD).

3.4 Domain Suspension: During the grace period, we may suspend services associated with the domain, including website hosting and email services.

3.5 Domain Deletion: If payment is not received by the end of the redemption period, the domain may be deleted and released back to the public domain for registration by any party.

4. REINSTATEMENT PROCESS

4.1 During Grace Period: To reinstate a domain during the grace period, simply pay the outstanding renewal fee. No additional restoration fees apply.

4.2 During Redemption Period: To reinstate a domain during the redemption period, you must pay:

• The outstanding renewal fee

• A redemption processing fee ($80-$150, depending on TLD)

• Any applicable registry redemption fees

4.3 After Deletion: Once a domain has been deleted after the redemption period, it cannot be reinstated through Modern Media Digital. You may attempt to re-register the domain if it becomes available, but there is no guarantee it will be available for registration.

4.4 Reinstatement Timeline: Reinstatement during the grace period typically takes 24-48 hours. Reinstatement during the redemption period may take 5-7 business days to complete.

5. CUSTOMER RESPONSIBILITIES

5.1 Contact Information: You are responsible for maintaining accurate contact information, including a valid email address and payment information.

5.2 Renewal Notifications: While we make reasonable efforts to provide renewal notifications, you are ultimately responsible for tracking domain expiration dates and ensuring timely payment.

5.3 WHOIS Information: You must provide accurate WHOIS information and update it as necessary in compliance with ICANN requirements.

6. TERMINATION AND CANCELLATION

6.1 Cancellation by Customer: You may cancel automatic renewal by notifying us at least 15 days before the renewal date.

6.2 No Refunds: Once a domain registration or renewal fee has been paid, it is non-refundable except as required by registry policies or applicable law.

6.3 Termination by Modern Media Digital: We reserve the right to terminate services for violation of these terms, illegal use of the domain, or as required by registry policies or applicable law.

7. GENERAL PROVISIONS

7.1 Registry Policies: All domain registrations are subject to the policies of the applicable registry and ICANN.

7.2 Limitation of Liability: Modern Media Digital is not liable for any damages arising from the loss of domain registration due to non-payment.

7.3 Force Majeure: Neither party shall be liable for delays or failures in performance resulting from causes beyond its reasonable control.

7.4 Dispute Resolution: Any disputes regarding these terms shall be resolved through arbitration in accordance with the laws of the State of Nevada.

7.5 Amendments: Modern Media Digital reserves the right to amend these terms at any time with notice provided to customers.

7.6 Entire Agreement: These terms constitute the entire agreement between you and Modern Media Digital regarding domain registration services.

By purchasing or continuing to use our domain registration services, you acknowledge that you have read, understood, and agree to be bound by these terms and conditions.
